Yes, ELs can be retained in a grade as long as you rule out English proficiency as the main or sole reason for the retention. If adequate supports were not provided, or you are uncertain about whether or not language proficiency is the root cause for the lack of academic progress, then you should reconsider retention and focus on the effectiveness of efforts to make content comprehensible for the student.
